Beds Norwich Terms & Conditions – purchasing online at bedsnorwich.co.uk
1.1 In these terms and conditions the following words shall have the following meanings:
“You” or “Your” means the person named in the order to whom we are supplying the goods to in accordance with these terms and conditions:
“We”, “Us” or “Our” means Sound Sleep Limited, Aloe Farm, Mile Road, Winfarthing, Diss, Norfolk, IP22 2EZ, owner of the brand BEDS NORWICH and bedsnorwich.co.uk; “Order” means your order for the goods; “Goods” means all the products listed in the order; “Special Order” means any goods that are made to a special size, non-stock item or goods ordered in a colour or fabric of your choosing. “Delivery” means the delivery of the goods to the delivery address specified in the order.
2.1 These Terms and conditions apply to all orders placed online at bedsnorwich.co.uk and over the telephone. By placing an order with Beds Norwich you are accepting to abide by these conditions. Please read them carefully and contact our sales team if you have any additional questions
2.2 If you do not wish to comply with our terms and conditions, then you should not place an order and enter into a contract with Beds Norwich.
2.3 These terms and conditions do not affect your statutory rights.
2.1 You should carefully check Your Order details before completing the order. You will receive an email confirmation of order, this is acceptance that a contract has been made between the Customer and Beds Norwich. You must inform us of any errors as soon as possible so these can be rectified.
2.2 It is Your responsibility to check:
(a) the dimensions of all Goods to ensure that they will fit into Your property; and
(b) that additional services requested (such as assembly or disposal) are clearly noted in the Order. These will be shown separately. If they are not included in the Order then these services have not been purchased and will not be provided.
2.3 All orders are subject to acceptance. All details supplied by the Customer must be accurate.
2.4 If there are any delays or problems with your order, we will contact you as soon as we are able.
2.5 All images displayed on bedsnorwich.co.uk are representations of the product and there may be some variations in colour and mattress tickings. Please visit the store and order to see colours if you wish.
4.1 In the event that any of our products are displayed with an inaccurate price we have the right to withdraw and cancel the order before a contract is entered.
4.2 In the event of any inaccurate descriptions on our products being found, we will rectify these as soon as possible.
5.1 The description of the Goods will be as specified within the Order.
5.2 You should be aware that:
(a) all sizes given are approximate and stated bed and mattress sizes refer to the sleeping surface only;
(b) mattress sizes may vary slightly from their stated dimensions due to manufacturing tolerances and can vary 2-4cm in width, length and depth of mattresses. This is to be expected with any products made from soft materials and is not considered a manufacturing fault; and
(c) firmness ratings are for guidance only.
3.3 We guarantee (the “Guarantee”) that for 12 months from the date of Delivery, the Goods will:
(a) be of satisfactory quality;
(b) be fit for the purpose for which they are designed and supplied;
(c) be free from material defects in design, material and workmanship; and
(d) comply with all applicable statutory and regulatory requirements for selling the Goods in the United Kingdom.
5.4 The Guarantee covers normal domestic home use only and does not apply to any defect in the Goods arising from fair wear and tear, wilful damage, accident, negligence by You, commercial use, failure to follow Our written instructions regarding care of the Goods, or any alteration or repair to the Goods which you carry out.
5.5 If you inform us that the Goods have breached the Guarantee, we will arrange an inspection to verify this. Before contacting us, please ensure you have your invoice to hand. If this inspection finds that the Goods have not breached the Guarantee, We will decline any further action, but provide full details of the reasons for the decision
5.6 If you would prefer to use an inspection service of Your choosing, then this must be done at Your cost. Any inspection service used must be a recognised, independent specialist.
5.7 In the rare event that Goods are found to have breached the Guarantee, We will follow a fair and fast process. We will either repair or replace the Goods free of charge. Alternatively, We may (if We choose) provide an alternative product to the value of the price paid by You for the Goods if we cannot replace for similar.
5.8 If claim under the guarantee is made, the guarantee will still run from the original delivery date of the goods.
5.9 The guarantee will be null and void in the following circumstances:
(a) Your new mattress is placed on an unsuitable base, for example an old sprung base or old base that has dipped
(b) Your new mattress has to be excessively bent to get it to the designated room
(c) Your new mattress is discoloured and stained. A moisture proof or waterproof mattress protector is essential. A full range are available to purchase from Beds Norwich.
- Availability of Goods
6.1 All goods and services are subject to availability and may be withdrawn at any time without notice.
6.2 Any goods or services that we are unable to supply will be refunded in full.
6.3 Goods not in stock will have an estimated leadtime. This leadtime is provided by our manufacturers and is subject to change. We expect our manufacturers to supply within this leadtime, however this is not always possible. Where there are any delays, we will contact you as soon as we can. Neither the buyer or seller is accountable for situations where delivery of goods is delayed for reasons beyond our control.
- Price and Payment
5.1 The price of the Goods will be the amount set out in the Order. Prices are liable to change at any time, but price changes after you have confirmed the Order will not affect the price for the Goods stated in Your Order.
5.2 All prices are in pounds sterling and include VAT at the relevant rate at the time of payment.
5.3 The total price payable for all items ordered will be debited from your account at the time of ordering.
5.4 We accept most major credit/debit cards including Visa and Mastercard. We use a secure payment method online provided by Stripe.
5.5 The payment card used, must be in the name of the person placing the order and they must hold a UK registered account and be over the age of 18 years.
5.6 Billing details provided must match those held by your bank card issuer. Failure to supply the correct information may result in your order being cancelled. Your order will only be processed once your payment card has been authorised.
8.1 Delivery will be made to the address provided on ordering.
8.2 Delivery lead times are given in good faith but are subject to change.
8.3 Delivery will be deemed to have taken place when the Goods have been delivered to the address set out in the Order. Delivery is to the room of Your choice at the delivery address. We do not need to satisfy Ourselves that the person accepting delivery at the agreed address is authorised by you to accept the Goods.
8.4 Failed deliveries will incur an additional delivery and administration charge of £40
8.5 If we are unable to complete a delivery due to the Goods not fitting in the room/up the stairs, you will not be eligible for a refund on this basis. You may order a different product as a replacement for the Goods. In these circumstances:
(a) You must pay the difference between the price of the Goods and any replacement product which is of higher value;
(b) You shall not be entitled to a refund of the difference between the price of the Goods and any replacement product which is of lower value; and
(c) You must pay an additional delivery charge and our reasonable administration costs.
8.6 The Goods may require some assembly. If you have purchased an assembly service, this will be carried out by the delivery team.
8.7 You should inspect the Goods carefully upon Delivery. If assembled by Us at the delivery address, Goods will be deemed accepted once assembled unless you inform us otherwise at the time. Where Goods are not removed from their packaging or you have otherwise not had a reasonable opportunity to inspect the Goods on Delivery, the Goods will be deemed accepted 7 (seven) days after Delivery.
8.8 We are not responsible for damages inside your home, please move pictures and ensure the path is clear. We may refuse to deliver to the room when there is no clear way through.
- Cancellation, Returns & Refunds
9.1 Once the order has been confirmed You cannot cancel it, except where We are unable to supply Goods in a reasonable delivery time.
9.2 Please check over your goods on delivery to ensure that the packing is intact and all items appear to be in good condition before you sign for them. If you find your goods to be faulty, damaged or incorrect please refuse the items and contact Customer Services as soon as possible. If you find that your goods are damaged after you have taken delivery please notify us as soon as possible. We ask that you inspect your goods within a reasonable time scale and prior to them being transported anywhere else.
9.3 If you are not satisfied with your purchase for any other reason (excluding manufacturing faults or misdescribed products) and report this, in writing, within 14 days, from the date of delivery, you will be given the option to return the product to us for a refund or exchange. You must ensure that the goods are unopened and it is your responsibility to return the product to us and to cover any associated costs of return. If you fail to take reasonable care of the goods before they are returned to us, and this results in damage or deterioration, we will seek to recover the reduction in value from you. This policy does not affect your legal rights. Any refunds will have an original delivery fee of £50 deducted.
9.4 For hygiene reasons we cannot accept any returns once items have been removed from their original packaging.
9.5 Beds, bases and headboards that have been ordered in a colour may not be returned as these are a special order to the customer’s requirements.
9.6 If a product has been used, deteriorated or been damaged in your care and through no fault of Beds Norwich or the manufacturer, the product is not eligible for return.
10 Nectar 365 Night Trial
10.1 To qualify for the Nectar sleep trial, you must keep the mattress a minimum of 30 nights. If you wish to end your sleep trial, you must notify us in writing by email. Nectar will arrange collection of the mattress and you may reselect a new mattress to the value of your original purchase. No refunds are given. If a more expensive mattress is selected, you will be required to pay the difference. One sleep trial per customer. There will be an administration fee of £50.
